Back Taxes and HOA Liens Get Paid at Closing

Unpaid property taxes and HOA dues grow fast with interest, fees and legal costs, and in Florida both can end with losing the house. If catching up isn’t realistic, selling for cash can pay everything off at closing and leave you with the equity. We buy houses and townhomes in Broward, Miami-Dade and Palm Beach counties for cash, as-is.

  • Back taxes, HOA balances and liens are paid from the sale at closing
  • You keep the equity left over
  • Close in as fast as 7 days, usually 2–3 weeks
  • No fees or closing costs; investing in Florida real estate since 2015

Unfortunately I had to sell my home after over 14 years and I had no idea how to begin. As fate would have it, Easy Home Buyer contacted me. After speaking with Elan, we were able to agree on a price and the ball was set in motion. Although I was feeling stressed about selling and having to move, I was also impressed by how fast and straightforward Elan was. Everything was going smoothly and I was starting to feel like I could get through this. Then we hit a snag. The house had been owner financed and for some reason, the lien holder was all but refusing to provide a payoff amount on my mortgage. I couldn’t believe it. I sent that guy a mortgage payment every month on time for over 14 years and he was doing this? My level of stress was through the roof. But through it all Elan provided so much support and reassurance. It felt like he really was on my side. It felt like he had an investment in me as well as the house. It was important to him that I was ok. I don’t know if I would have made it through without that. Well, Elan and the Title Company really put the pressure on the lien holder and he finally had to provide the information. Everything after that went exactly as promised. I was able to find a nice place and, although it’s an adjustment, I really like it. I can’t thank Easy Home Buyer in general and Elan specifically for all they have done. Sincerely, John Raimer

We had been trying to sell my in-laws former home for some time - it is a unique house in a secluded area and it needs a bit of work. From my first contact with Elan, the process was seamless. He was informative, knowledgeable and, most of all, patient with us! My 88 year-old mother-in-law had a difficult time letting go of her treasured home but Elan did an amazing job getting her through the process. Honestly, I was a bit apprehensive dealing with “house flippers” - we had been burned before - but I would recommend Elan and his company 10 times out of 10. A was a great pleasure doing business with this company!

Common Situations We Help With

Years of unpaid property taxes. A tax certificate has been sold on the house and the clock is running toward a tax deed sale.

HOA dues and special assessments. The balance has grown with late fees and attorney fees, and the HOA has sent a lien or foreclosure notice.

Taxes went up after a sale or inheritance. The homestead cap no longer applies and the new bill is more than you can carry. Selling an inherited house

Code enforcement liens. City fines that turned into liens on the property. Selling with code violations

Behind on the mortgage too. If your lender has started a foreclosure, time matters. Selling before foreclosure

How Back Taxes and HOA Liens Work in Florida

Knowing the timeline helps you see how much time you have:

  • Property taxes are due by March 31 and become delinquent on April 1.
  • Tax certificates are sold by June 1. An investor pays the overdue taxes and earns interest, and a lien stays on your property.
  • A tax deed sale can follow. Two years after the certificate is issued, the holder can apply for a tax deed, and the county can auction the property if the taxes still aren’t paid.
  • HOAs can lien and foreclose. Florida HOAs can record a lien for unpaid assessments and foreclose on it, but they must send written notices first, which gives you time to act.
  • Everything is paid at closing. When you sell, the title company gets payoff figures from the tax collector and an estoppel letter from the HOA, and those amounts are paid from the sale.

This is general information, not legal advice. A Florida real estate attorney can tell you what applies to your situation.

Speed
Cash offers are typically quicker than traditional home sales. There is no need to wait for a mortgage to be approved, which can take several weeks or even months. .

Certainty
Cash offers are usually considered more certain than traditional home sales because the buyer has the funds readily available and does not need to secure financing. This can help to avoid last-minute complications or delays in the closing process.

Simplicity
Selling a house through a cash offer can be a straightforward process. There is no need to make repairs or improvements to the property, and there is no need to stage the home for showings.

Flexibility
Cash buyers are often willing to close on a date that is convenient for the seller. This can be especially beneficial if you need to move quickly or are looking to avoid a long closing process.

Avoiding Foreclosure
In some cases, cash buyers may be able to help homeowners avoid foreclosure by purchasing their property quickly.

How It Works

Four steps, and the liens are handled at closing.

Step 1

Talk with us. Tell us about the house and any notices you’ve received from the county or HOA.

Step 2

Get a cash offer. After we see the house, you get a written offer, and we order the tax and HOA payoffs.

Step 3

Sign where you are. A mobile notary comes to you.

Step 4

Close and get paid. A title company pays the taxes, HOA and any loan, and the rest is paid to you.
